Characteristics of a Writ of Mandamus

 

  1. A Writ of Mandamus is a court order from a higher court to a lower court or other government body ordering it to do something that the law requires.

  2. In the context of immigration, this typically refers to a lawsuit brought against the United States Citizenship and Immigration Service (USCIS) seeking to compel the agency to act on a specific case.

  3. This kind of lawsuit should be seen only as a very last resort after every other avenue has been fully explored. Although a Writ of Mandamus may compel the USCIS to expedite the processing of applications which have been delayed for some reason, they cannot compel USCIS to rule favorably for the petitioner.
